Welcome to Bytecurve’s BusAlert mobile application and associated services (“BusAlert”).  This Privacy Policy (“Policy”) describes how Bytecurve (“Bytecurve”) uses and protects any “Personal Information” (i.e., information that can be used to identify you and any Student(s) associated with you) that Bytecurve collects when you set-up and use BusAlert.  By using BusAlert, you agree to the terms of this Policy and consent to Bytecurve’s use of the Personal Information and any other information that Bytecurve collects through BusAlert.  Any capitalized terms not defined herein shall have the meaning ascribed in the BusAlert Terms of Use found here.

Bytecurve is committed to ensuring your privacy and protecting the privacy of all Personal Information related to the usage of BusAlert.  Bytecurve does not sell data (including Personal Information) associated with BusAlert, and Bytecurve shares Data with third parties only to the extent necessary to provide BusAlert, as further described herein.


Consent

By registering for, accessing, or otherwise using BusAlert, or by submitting Personal Information in relation to your use of BusAlert, you agree to the terms of this Policy, and you expressly consent to the collection, use and disclosure of Personal Information in accordance with this Policy.


About Bytecurve

Bytecurve operates as a service provider for the individual school, school district, school bus operator, transit authority, and/or fleet operator that provides your Student with transportation services (“Customer”) in a business-to-business context.  In support of these student transportation services, Bytecurve contracts with the Customer for the Customer’s provision of BusAlert to you.


Special Note About Children

As necessary to provide BusAlert, Bytecurve may collect, process, store, and otherwise use Personal Information about Students under the age of 13 as described in this Policy.  This Personal Information is essential to enabling Bytecurve to provide BusAlert, as well as associated services that Bytecurve is contractually obligated to provide the Customer.  

To the extent Bytecurve collects, processes, stores, and/or uses Personal Information associated with Students who are under the age of 13 to provide BusAlert, Bytecurve is doing so as a service provider and contractor (or subcontractor) for the School. In order to implement reasonable procedures to ensure that Bytecurve is dealing with any such Student, the Student’s parent, the Student’s legal guardian, or other such authorized caregiver of the Student with respect to providing access to BusAlert Data, Bytecurve may require you to provide certain details (including, but not limited to, name, e-mail address, Student name and Student identification) to verify you and authenticate your access.

All Data, including Student Personal Information, is collected by, accessed in, processed by, or otherwise used by Bytecurve to provide BusAlert at the direction of the School.


Summary of BusAlert 

BusAlert allows you to view certain School Bus information and other information related to your Student’s School Bus. Bytecurve may combine that information with other information provided by the School regarding your Student and information it collects about the School Bus.

By downloading, agreeing to, registering for, and otherwise using BusAlert, you will be asked to authorize Bytecurve to send push notifications regarding School Bus status and other messages initiated by the School. You hereby consent to the delivery of push notifications directly to your Device. You understand and agree that standard text message and data rates may apply and that you, and not Bytecurve, are responsible for such charges. You may opt out of receiving such push notifications by changing notification settings on your Device; however, disabling push notifications will impact your use of BusAlert.

Personal Information Collected

In providing BusAlert, Bytecurve may collect, process, transfer, or otherwise have access to various information and data, including certain of your Personal Information and certain of your Student’s Personal Information. 

Bytecurve may collect Personal Information that can be used to identify you or your Student individually or your household, such as your name and email address and your Student’s name, School, unique personal identifier and grade.

More specifically, the types of Personal Information that Bytecurve may collect about you (or your Student) during your registration for and use of BusAlert or otherwise in connection with the provision of services to the Customer include:

  • Student Information. Bytecurve may collect Student name, identification, School and grade.
  • Parent (or other authorized user of BusAlert). Bytecurve may collect name and email address.
  • “Personal Information” defined by California Civil Code Section 1798.80. 
  • Internet or other Electronic Network Activity Information. Bytecuve may collect certain data regarding your use of BusAlert App and information regarding your interactions with Bytecurve.
  • Geolocation Information. Student bus location.
  • Device Features. Bytecurve may request access to certain features on your Device.
  • Customer Support Data. Information collected when employees of Bytecurve’s Customers contact Bytecurve for help regarding BusAlert (e.g., name, telephone number and contact information, summary of issue discussed, and audio recording of voice call interactions for Bytecurve’s internal use).

 

Sources of Personal Information

 Bytecurve collects information about you and how you interact with BusAlert in several ways, including:

  • Information you Provide Directly. Bytecurve collects the information you provide to Bytecurve directly.
  • Information from your Mobile Device. Use of BusAlert requires access or permission to certain features of your Device. If you wish to restrict Bytecurve’s access or permissions, you may do so in your Device’s settings. Restricting Bytecurve’s access may negatively impact your use of BusAlert.
  • Information Automatically Collected or Inferred from your Interaction with Bytecurve. Bytecurve automatically collects technical information about your interactions with BusAlert (such as IP address and browsing preferences), as well as from your interactions with Bytecurve’s representatives and agents.
  • Information from the School. Bytecurve receives information about your Student and other information from the School, including School name, Student name, Student identification, School Bus information, and details about School Bus routes.
  • Information from Third Parties. Bytecurve may receive information about you and your interactions with BusAlert from third parties, including others interacting with Bytecurve and/or using services associated with BusAlert.

Bytecurve may combine information received from the various sources described in this Policy, including third-party sources, with Personal Information and use or disclose it for the purposes identified below.


How Bytecurve uses your Personal Information

  • To Provide BusAlert and Enable Interactions between you and Bytecurve. Bytecurve will use your Personal Information to deliver BusAlert and its associated services.  This includes, but is not limited to, registration and administration of your account; providing you with and support in your interactions with Bytecurve; diagnosing, repairing and tracking service and quality issues; providing requested information; communicating with you about your account or Bytecurve’s data practices; installing and configuring changes and updates to BusAlert, programs and technologies related to interactions with Bytecurve; authenticating those who interact with Bytecurve; or to respond to your requests, complaints, and inquiries.
  • To Provide Customer Support. Bytecurve may use your Personal Information to investigate and assist you in resolving questions or issues you have regarding BusAlert.
  • For Internal Business Purposes. Bytecurve may use your Personal Information for internal business purposes related to providing BusAlert, as well as other products and technologies. This includes, but is not limited to, evaluating or auditing the usage and performance of BusAlert; designing new services; processing and cataloging your responses to surveys or questionnaires (e.g., customer satisfaction reviews); performing internal research for technological development and demonstration; conducting data analysis and testing; and maintaining proper business records and other relevant records.
  • For Legal, Safety or Security Reasons. This includes complying with legal requirements; protecting the safety, property or rights of Bytecurve, you, and those who interact with Bytecurve or others; and detecting, preventing, and responding to security incidents or other malicious, deceptive, fraudulent, or illegal activity.
  • In a De-identified, Anonymized or Aggregated Format. When converted to a de-identified, anonymized, or aggregated format, Data no longer constitutes Personal Information, and Bytecurve may use this information for any purpose.
  • For any Other Purpose for which you Provide Consent.


Sharing of Personal Information

Bytecurve does not currently sell Personal Information, nor does Bytecurve have any future plan to do so.  However, to provide BusAlert, Bytecurve may share your Personal Information with these recipients:

  • The School.  Bytecurve will share information, including Personal Information, with the Customer in order to (a) provide you BusAlert and (b) provide the School and/or Customer with the services requested pursuant to the Customer’s contract with Bytecurve.
  • Affiliates and Subsidiaries. Bytecurve may share your Personal Information within the Bytecurve group of companies, which includes parents, corporate affiliates, subsidiaries, business units and other companies that share common ownership for the purposes described above.
  • Service Providers. Bytecurve may share your Personal Information with third-party service providers working on behalf of Bytecurve in order to provide BusAlert, such as hosting service providers, IT providers, operating systems and platforms, internet service providers, and analytics companies. Bytecurve provides these third-party service providers with only the information they need to perform their services and work with them to ensure that your privacy is respected and protected.
  • For Legal, Security and Safety Purposes. Bytecurve may share your Personal Information with third parties such as law enforcement or other government agencies to comply with law or legal requirements; to enforce or apply Bytecurve’s Terms of Use and other agreements; and to protect Bytecurve’s rights and the property or the safety of Bytecurve, Bytecurve’s users, or third parties.
  • In Connection with a Transaction. If Bytecurve sells some or all of its assets, or merges or is acquired by another entity, including through a sale or in connection with a bankruptcy, Bytecurve will share your Personal Information with any such entity.
  • Based on Customer Direction. Bytecurve’s Customers often want their data to be shared with third parties that provide complementary products and services to the Schools.  This data sharing is often enabled by application programming interfaces (API). Bytecurve will enable data sharing with these third parties via API only when authorized to do so by the Customer and School.


Security

Bytecurve takes your privacy seriously and uses reasonable precautions to protect your Personal Information. For example, Bytecurve encrypts certain communications using industry standards for encrypting such communications. However, Bytecurve does not guarantee the security of your information.  There is always a risk that information collected or that you provide may be compromised.  To mitigate this risk, you should (a) use secure usernames and passwords and carefully protect them from disclosure and (b) implement up-to-date security and virus protection on your Device.  If you suspect that your Device’s security or your information has been compromised or your password accessed or used by an unauthorized third party, please contact Bytecurve immediately to have your password changed.


Third Party Websites

When you click on a link or otherwise exit BusAlert and are navigated to any other website, mobile app or other Internet location, you will leave BusAlert and any such link, website, mobile app or other Internet location may collect Personal Information from you. Bytecurve has no control over, does not review, and cannot be responsible for, these outside links, websites, mobile apps or other Internet locations or their content or collection of Personal Information. Please be aware that the terms of this Policy do not apply to these links, websites, mobile apps or other Internet locations, or to any collection of data after you exit BusAlert.  If you decide to access any third-party links, websites, mobile apps or other Internet locations outside of BusAlert, you do so at your own risk.


Changes to Personal Information

You may change certain Personal Information you provide to Bytecurve (such as your name, password, and associated Student(s)) by editing your BusAlert profile. You may request deletion of your Personal Information and Bytecurve will delete it.  Please note that Bytecurve may be required by law or otherwise to keep this information and not delete it (or to keep this information for a certain time, in which case Bytecurve will comply with your deletion request only after it has fulfilled such requirements).


For California Consumers

The following provisions apply to residents of the State of California:

  • Do Not Track. Bytecurve supports and honors “Do Not Track” web browser settings.  If you visit Bytecurve’s website and enable Do Not Track settings in the browser you are using, Byetcurve will not collect, store, or use Personal Information about websites you visit using that browser other than websites operated by Bytecurve (“Bytecurve websites”). Other parties, however, may not honor Do Not Track settings.  These parties may collect Personal Information about your online activities over time and across different websites when you visit Bytecurve websites, for example by using cookies on Bytecurve websites.  Byetcurve has no access to or control over other parties’ Personal Information collection practices. You should carefully review the privacy policy and terms of use of any website you visit. 
  • CCPA. You may have certain rights set forth in the California Consumer Privacy Act of 2018 (“CCPA”). However, in providing BusAlert, Bytecurve’s collection, processing, storage, and use of Personal Information is undertaken while Bytecurve is acting as a “Service Provider” (as that term is defined in the CCPA) to Bytecurve’s Customer.  In this case, consistent with the CCPA, Bytecurve may direct you to Bytecurve’s Customer, in order to exercise your rights under the CCPA.


Acceptance of Policy

By downloading, accessing, and/or using BusAlert, or otherwise providing your Personal Information to Bytecurve, you signify your acceptance of this Policy. If you do not agree to this Policy, please discontinue your use of BusAlert.


Modifications

Bytecurve may modify this Policy from time to time as BusAlert and applicable laws change.  If this Policy is changed, Bytecurve will post the newly revised version of this Policy and update the effective date stated at the end of this Policy.  You are encouraged to review this Policy from time-to-time for any updates or changes. If Bytecurve make any material changes, Bytecurve will inform you through BusAlert or by some other method of communication.
